Of all of the taxes imposed on individuals and businesses, the taxes which are taken the most seriously by governmental units are the employment taxes known as the “trust fund taxes”. These taxes generally refer to the tax which is taken from the paycheck of an organization’s employees, which is then supposed to be forwarded to the Federal or State Government. Other employment taxes include the so-called “F.I.C.A.” tax, or any similar tax under which the employer is generally supposed to include either a matching contribution to the employees tax or an additional payment based on the amount paid to the employee. Employment taxes are generally accounted for on forms 940 and 941.
There can be a variety of issues which arise when dealing with employment taxes, common issues is whether a worker is an employee or an independent contractor, or whether a business owner is required to declare that a portion of the income from the business has to be declared as wages and thereby subject to these taxes.
If you don’t pay your employment taxes, the liabilities mount up quickly. If you don’t pay your employment taxes you may be visited by a Revenue Officer from the Internal Revenue Service or other Tax Law Enforcement Officer, who will begin taking enforcement action.
The penalties for not filing and for not paying or paying late are both extremely high and mount up quickly.
